做为发达国家和发展中国家对抗与妥协的产物,至今尚未正式复查的《TRIPS协定》第27.3(b)款在执行过程中,围绕"专利方式"和"有效的特殊体系",各类案例裁决、立法争议,此起彼伏。从生态政治学角度,审视这一执行现状,指出对发展中国家而言,为维护粮食安全,在执行该条款和考虑其复查方向时,虽以激励创新为基本要义,但应适当考虑不同育成品种的公平保护、育种的可持续创新、弱势利害关系者利益的维护。

  • The article 27.3.(b) of TRIPS Agreement which has not been be reviewed yet,is the result of struggles and compromises between developed countries and developing countries.In the implementation of the article,many verdicts and legislative controversy around the "by patents" and "by an effective sui generis system" arose one after another.From the perspective of ecopolitics to observe the current situations of the implementation,we should be aware that,in order to protect the food safety,though incentive innovation is the basis of the article,developing countries still need to consider about the fair protection between different improved varieties,the sustainable innovations of breeding,the benefits protection of the vulnerable stakeholders in the performance of the article.
