摘要：

汉冶萍公司是近代中国洋务运动的产物,曾被誉为亚洲第一雄厂,代表着一代精英实业救国的梦想。但时值国家民智未开,国民严重缺乏理性的财产权观念,再加上其深处封建生产关系的泥沼,本身又得不到来自宪法授权的国家权力的强有力保护,因而在历次对外贸易中饱受日本帝国主义势力的盘剥与压榨,继而走向衰亡。用法律的理性思维来检视汉冶萍公司的兴衰过程,可折射出一幅近代中国身处逆境仍挣扎图强的图景,同时也为今天中国的法治建设提供了若干启示。

  • The Hanyeping Company is the product of Westernization Movement in modern China,once hailed as the first largest enterprise,which represents the elite generation's dream of saving the nation by engaging in industry. But as the wisdom of the people was not enlightened,with severe lack of rational awareness of property right and being struck in the productive relations of feudalism,the nation was not protected by state power authorized by the constitution. Accordingly,the Hanyeping Company had been exploited by Japanese imperialism forces during the process of international trade and collapsed finally. The analysis of the rise and fall of the Hanye Ping Company in terms of law will reflect a picture of recent China in adversity struggling to be stronger;its conclusion will provide some implications for the Law construction in China today.
