人民法庭的发展经过了建国后的"革命法庭"、改革开放后的"政法法庭",直到现在的"国家法庭"三个阶段,人民法庭的发展在每个阶段都有自己的规律和特点。在国家治理现代化的背景下,中国的人民法庭面临着治理资源有限导致供给不足、自利化倾向导致基层治理内卷化、工具技术操作架空国家法律、权力网络压抑程序自治成长的突出问题。展望未来,必须继续坚持人民法庭制度,坚持人民法庭发展的改革方向,提出前瞻性和实践性相结合的治理方案,从国家治理资源供给、强化人民法庭管理;确保规则与技术的平衡;强化司法自治的角度进行制度性变革,实现通过人民法庭实现国家治理现代化的伟大梦想。

  • The development of people's court has undergone three stages: the revolutionary court after the founding of the People's Republic of China,the political science and law court after China's opening up to the outside world and the state court of today's China. Every stage of the people's court has its own rules and characteristics in its development. Under the background of the modernization of national governance,the people's court faces several problems: limited resources that leads to the insufficient supply; self-interest that leads to the involution of grassroots governance; tools and technical operation that overhead the law; network of power that depresses the autonomy of law. Looking forward to the future,we shall continue to adhere to the people's court system,adhere to the reform direction of the development of the people's court,put forward the scheme of forward-looking and practical combination of governance,which includes the resource supply of national governance; strengthening the management of the people's court; ensuring the balance between rules and technology; strengthening judicial autonomy. In this way,China can realize the dream of the modernization of governance.
