摘要：

侵权责任法的传统理论以有体物为展开基点,其历史演进的过程既体现了时代的发展与要求,亦是法律体系自身不断完善的表现。但以非物质性的权利为调整对象的知识产权,使一些区别于传统民事侵权行为的知识产权侵权行为也得以呈现,继此对侵权责任法造成了冲击。故从知识产权权利对象的非物质性这一本质特征出发,联系传统侵权责任的理论演进与制度变革,可从理论层面回应目前知识产权对传统侵权责任法的冲击,并塑造知识产权侵权行为的法律构造。

  • The traditional theory of tort law is based on res corporals. Its historical evolution process not only refl ects the development and requirements of the times, but also represents the constant improvement of legal system. However, the objects regulated by intellectual property law are intangible rights, consequently IP infringement behavior often carries different features from that of traditional civil trespass, and brings about great impact on tort law. The article sets out from the essential feature of the objects of IP rights, i.e. incorporeity, taking into consideration of theoretical evolution and institutional reform of traditional tort liability, and tries to give a theoretical response to the impact on traditional tort law caused by intellectual property. Meanwhile, the article also tries to structure the law framework of IP infringement.
