摘要：

一般认为,罗尔斯对其正义的原则的证成就是"从原初状态出发的论证",这条正式的证成路线受到了许多批评者的关注。但是,很少有人注意到,《正义论》中还存在着另外一条论证路线,它使得公平正义的第二个原则可以不依靠原初状态的设置就得到初步的证成。这条证成路线,在力图满足效率原则的条件下,从机会平等迈向收入平等,再经由一个基于帕累托优化的概念,最后达到差别原则。

  • It is generally believed that Rawls' justification of the principle of justice is the " argument of starting from the original position"; this formal route has got the attention of many critics. However,few people noticed,in " A Theory Justice",that there is another argument that it makes the second principle of justice get preliminary justification not depending on the set of the original position. This route,trying to meet the conditions of the principle of efficiency,makes its way from the equality of opportunity towards income equality,through another conception based on Pareto optimization,finally to reach the difference principle.
