犯罪构成体系不仅是刑事实体法的一个范畴,而且在程序法层面上也具有重要的意义,各国犯罪构成体系的形成及运用和刑事诉讼程序有着密切的联系。针对我国"四要件"构成体系反映到诉讼程序上的弊端,可以考虑引入具有较强程序功能的"三阶层"模式,在侦查阶段、审查起诉阶段,特别是审判阶段,"三阶层"犯罪构成体系能发挥出更优于"四要件"体系的程序功能。

  • The crime constitution system is not only a category of criminal substantive law, but also hassignificance on the level of procedural law. The form and use of crime constitution system of various countries isrelated closely to criminal procedure. Aiming at the drawbacks the"four elements"constitution system reflectson legitimate procedure, we can consider introducing"three stratums"mode which has stronger procedurefunction. In the stage of investigation, review and prosecution, especially in the stage of judgment, the"threestratums"crime constitution system can exert better procedure functions than"four elements"system.
