在职权型诉讼构造下,合议庭评议存在的"合而不议",法官"独白"之现象,抑制合议庭功效之发挥。具有主体间平等性、言说推理性和程序正当性特质的合议庭评议对话,旨在促进参审人员就案件事实认定和法律适用问题达成共识。合议庭评议对话依赖于诉讼主体间平等对话,聚焦当事人论辩意见,确立评议对话结论的逻辑性、结果的共识性和说服他人的可接受性,以促进合理的、可接受的评议结果的形成。

  • Under current inquisitorial litigation structure,it is a common phenomenon that the trail judge take a " monologue" without discussion and trial on the collegial panel,resulting in a bad effect to play. Equality,logicality and collegiate procedure property are the key factors to promote the judges focusing on the fact-finding and consensus on the application of the law,leading to a reasonable and acceptable verdict. The collegiate conversation relies on the subject of conversation on an equal footing. And the logicality of the statement,the consisitcy of the result,and the acceptability of persuading others should be all taken into the trailing consideration.
