美国1953年制定的《小企业法》是美国小企业法律体系的基础,2016年该法进行了大规模的修订,在立法目的、立法调控方向、调控手段等方面都发生了巨大的变化。新法在继续重视反垄断、保障自由市场公平竞争的同时,更加注重对小企业在金融、财税等方面的直接扶持,并在反垄断豁免、环保、技术转让、法律文书简化等方面做出新的倾斜性规定,而且还针对特殊群体所有企业专门制定微型贷款、特殊担保、快速贷款等扶持措施。《小企业法》的此次修订标志着美国小企业法体系在整体上完成了更新改造。

  • The Small Enterprise Law of the United States of America made in 1953 is the foundation of the American legal system for small businesses,with the revision of the law on a large scale in 2016,great changes have taken place in such aspects like the legislative purpose,legislative regulation direction,and control methods. The law attaches great importance to the antitrust,security of fair competition on the free market,at the same time,pay more attention to the financial,fiscal and direct taxation support,and antitrust immunity,environmental protection,technology transfer,and make simplified legal document,the law also give enterprises owned by special groups formulated microcredit,special support measures such as guarantee,fast loan. The revision of the Small Enterprises Law marked upgrading on the whole for the law system.
