“盗”罪是中国最古老的犯罪之一,而且是历代统治者最重视的犯罪之一。“王者之政莫急于盗贼”,有关盗罪的立法是古代法律发展中的重要内容。在中国古代法律发展的过程中,秦汉是中国传统法律制度形成和发展的重要时期。在秦汉律的基础上,经过魏晋南北朝的不断发展,集大成为隋、唐律。因此,秦汉立法在中国法律史上具有极其重要的地位,“盗”罪立法是秦汉法律制度的重要组成部分,对中国传统法律产生了重要影响。 全文由导言、正文组成。导言部分主要说明本选题的研究价值,研究现状及笔者所采用的研究资料、运用的研究方法等问题。正文由三个部分组成: 第一部分:秦汉时期“盗”罪罪名溯源。主要考察三个问题:其一,“盗”字的含义。其二,“盗”罪罪名的历史沿革。其三,秦汉之际律典中《盗律》篇设置的沿革。对此三个问题的考察均以时间为线索,纵向考释分析秦汉时期及之前“盗”字的涵义,“盗”罪罪名沿革的考察及秦汉律典中《盗律》篇的设置,深入探析“盗”罪罪名在秦汉之前的历史演进及秦汉时期“盗”罪罪名的历史源流。 第二部分:秦汉时期“盗”罪之规定的发展演变。主要考察两个问题:其一,秦汉“盗罪”类型及其立法规定。通过对秦汉简牍资料及传世文献资料的梳理,可以发现秦汉时期的“盗罪”主要包括:盗窃罪、强盗罪、略人、劫人、盗杀伤人、受赇以枉法及行赇、假借官物罪以及其他形式的“盗”罪。其二,秦汉时期对盗罪的处罚原则。从秦汉立法可见,秦汉法律对“盗”罪进行处罚的司法原则主要有:并赃论罪原则、平价原则以及追赃原则三项原则。本部分通过秦汉之间“盗”罪表现形式及其司法原则的对比分析,以期待对秦汉“盗”罪做出对比。 第三部分:对秦汉时期“盗”罪立法体系的历史评析。本部分主要利用法律社会学,法律经济学等理论资源,对秦汉时期“盗”罪立法构架和立法精神进行总结与审视。笔者认为:中国古代“盗”罪的立法精神,首先关注的是维护统治秩序的稳定,其次才是对官私财产权利的保护,而二者又是相辅相承的。为维护统治秩序,历代法律不惜以重刑治盗,从而形成了中国古代盗罪立法重刑主义的基本传统。秦汉法律内容大体上是相同的,基本上是法家思想的产物,是战国以来变法活动的成果。因此,秦汉有关“盗罪”的立法构架也是一脉相承的。汉代的“盗”罪立法除了继承秦制之外,于汉初也作了较大修改,随着社会历史的发展变迁,秦汉资盗罪立法也在发生着相应的发展变化。 在撰写此文过程中,笔者试图采用王国维先生提出的“二重证据法”,即把发现的史料与古籍记载结合起来以考证古史的方法,对秦汉“盗”罪进行较全面深入的论析。笔者也吸收学术界相关的最新成果,以期在前人研究的基础上有所突破,试图解决前人研究秦汉时期“盗”罪制度一些遗留问题。

  • "Pirates", is one of most ancient crimes, moreover is one of crimes which the Chinese all previous dynasties ruler most takes. "The most urgent priority is to punish theft and the thieves for the politics", the concerned larceny crime legislation was in the ancient times law development important content. In China ancient times in the legal development process, the Qin and Han Dynasties were the Chinese tradition legal regime forms with the development important times. In the Qin and Han Codes foundation, passes through the Wei Jin Southern and Northern Dynasties' unceasing development, epitomizes for the Sui and Tang Codes. Therefore, the Qin and Han Chinese at the legal history of the Legislative Council has an extremely important position, "Pirates" legislation is the the Qin and Han Dynasties legal regime important constituent, have had the important influence to the Chinese tradition law. The full text is devided into the introduction and the text.
