自由主义者哈耶克一生追求自由,他不是将自由建立于道德权利理论上而是追寻“法治下的自由”。 本论文主要分析了哈耶克法治思想的理论基础,主要内容以及其内在发展思路。哈耶克最原创的贡献在于他认识到人类社会中除了存在组织(国家是特殊的形式)秩序外,还有一种自生自发秩序(哈耶克又称为“自我生长的秩序”扩展秩序)尽管社会中这两种秩序会始终共存,但是,任何组织的有效运转都必须被整合进规模范围更大、复杂程度更高、更能提供人以自由的自生自发秩序中。将社会秩序同质化,进而将社会秩序规则同质化,视一切法律皆为立法者意志的体现,在哈耶克看来,这些都是对法治,对自由的践踏。 哈耶克首先视自由为“法律下的自由”,法治是一种政治理想是一超立法原则,“法治之法”应该是具有普遍抽象性、确定性和平等性的规则。后来他又明确表示,普通法体系符合法治精神,普通法除了具有上述“法治之法”的特征外,还有其“否定性正义”标准和“相融性检测”标准更能保障自由。其法治思想可概括为“普通法法治国”的话语。 本文共分四部分加上前言和结语共七万字。 前言部分概略地分析了哈耶克法治思想生成发展的脉络。 第一部分论及哈耶克法治思想的理论基础:知识论自生自发秩序文化进化观。 第二部分阐释哈耶克早期法治思想“重述古典自由主义的原则”。 第三部分讲哈耶克如何批判当前法治遭受的危险:法律的修正与命令的制定混于同一机构、公法统摄私法、法律实证主义特别是纯粹法学的流毒,无限民主是一种专制“社会正义”是幻觉。 第四部分:其所谓的“普通法法治观”的具体内容。 结语:论者们对哈耶克法治理论的批评检视。

  • Friderich. Von A Hayek, a classic liberalist, has been seeking for freedom all his life. Instead of basing his theory of freedom on any moral rights, he claims for "Freedom under the Law". This article deals with his theoric foundation, maior content and inner logic development of his legal thought. One of his greatest contributions to political theory is his recognition of spontaneous order in contrast to organizations, among which state is very special Although, the two orders Spontaneous order and organization, are co-existing in a society, an organization must be set in the more complex, Larger spontaneous order, Which can provide much more freedom. Hayek views these ideas as the infringe ment to the rule of law and freedom: the two social orders are of the same quality thus the two kinds of rules of the same quality, all the laws are the embodiments of the will of the legislature. In Hayek's eyes freedom is "freedom under the law," the "rule of law" is a kind of political ideal and a meta-legal doctrime the law in the "rule of law" should be abstract general, certain and equal, later he pays much more attention on the common law system, which would be in compliance with his rule of law and which can protects freedom better because of its "Negative justice" and "Hamoneous standard" His legal thought can be concluded as Common law state This article consists of 4 Parts as well as a preface and a conclusion, which is70000 words altogether. In the preface the outline of the growth and development Hayeks legal theory is shown. In the first part, his theoretic foundations such as ontology, spontaneous order, cultural evolution are discussed. Hayek established a frame work by "rule of law" in his early years. He also retold the history of the rule of law. In his view. Any law which is in compliance with the meta-legal doctrine would provide protection for freedom. These are in the second Part. However, the real ity is far from what he desired. The "rule of law" as well as freedom has been destroyed into pieces, due to the wrong theory and intended damage. It is Hayeks bravery and courage that stimulates him to make people be more careful about the facts and the danger In the third part his work is exhibited in de tail Hayek constructed his legal theory by resorting to common law system, to which he attributes so many advantages. This is the fourth part. Hayek should be proud of his achievement in establishing his legal theory and freedom under law without moral rights theory.
