摘要：

宅基地是农村的农户或个人用作住宅基地而占有、利用本集体所有的土地。宅基地使用权是我国特有的一种用益物权形式。目前,农村闲置宅基地的大量存在并呈不断增加之势,造成了土地资源的巨大浪费。造成农村宅基地闲置的原因是多方面的,但制度性缺陷是重要因素,应尽快积极探索宅基地使用权流转办法,在尊重农民意愿、保障农民权益的原则下,整合农村零星、闲置、低效利用的土地资源,依法盘活和利用好农村现有宅基地,探索建立符合农民合理需求的宅基地退出补偿激励机制,建立规范的农村宅基地市场,最终达到提高土地利用效率和集约化水平的保护土地资源的目的。

  • The housing land in rural households or individuals for residential base and possession,use of the collective-owned land.Housing land use right is a unique kind of usufructuary right in China.Currently,there are a lot of idle rural homestead and showed increasing trend,resulting in a huge waste of land resources.Cause of idle rural homestead is multifaceted,but the institutional defects is an important factor,should actively explore ways to transfer of land use right as soon as possible,establish a standardized rural homestead market,while respecting the wishes of farmers,under the principle of protection of farmers' rights integrated rural sporadic,idle,inefficient use of land resources,according to compensation incentives,and ultimately achieve the purpose of improving the protection of land resources and intensive land use efficiency levels.
