<正>后期维特根斯坦对语言的分析主要是从语言与日常生活的关系加以论述,其中以"语言游戏"理论为代表。这一核心概念与"家族相似性"、"生活形式"、"遵守规则"等重要概念密切相关。生活形式是多种多样的,所以语言游戏也是如此。他认为语言在使用中才有意义,词语的意义就是它的用法,体现在其具体的语境中,即意义的"使用论"。他强调了对日常语言

  • Later Wittgenstein put forward ‘‘language games", which is closely related with such concepts as"family resemblance", "forms of life,,and "abiding by rules',. He focused on analyzing the ordinary language. He said "the meaning of a word is its use in the language". According to him,the semantic meanings of a word are not fixed. They are influenced by contextual factors such as society, culture and persons. The concept of linguistic philosophy of later Wittgenstein influenced philosophy of language, especially the ordinary language.Context refers to the conditions in which something exists or occurs. Linguistically, this is the part of a discourse surrounding a word or passage that helps make its meaning clear, including specific time, places, situations and persons. It also includes the language users* status, thoughts,personality, character, mood etc. Malinowski put forward situational context; Firth advanced linguistic context; Halliday brought forward register including field,tenor and mode; and Leech put forward the background shared by speakers and audience.From the above, we can see that the "meaning as use" of later Wittgenstein and the context theory have the same ideas. This paper gives some examples to explain the "meaning as use" and the context theory. It indicates that the contextual factors must be taken into consideration so that we can understand and grasp the meaning of legal discourse and connotation of the legal terms.
