摘要:

行政约谈以其非强制性、柔和性、协商性的优势在行政管理中越来越受到青睐,近年来已经逐步成为环境执法中一项制度。当然,环境行政约谈不仅契合了服务型政府的目标,而且创新了环保执法的方式,环境行政约谈越来越受到环境行政执法部门的认可。但是行政约谈本身尚属于一个定性不明确的法律制度创新,相关争议较大,新近发展出来的环境行政约谈制度也难逃窠臼。另外一方面,近年来,从中央到地方出台的大大小小的文件中很多提及“约谈”,甚至还有专门环境约谈制度的面世,这与其本身的不确定性大相径庭。因为此,坊间质疑之声也未终止,而现实中似乎也开展的如火如荼。本文将在这一个大的背景下展开。为了全面研究环境行政约谈制度,本文主要从四个方面展开:第一章是对行政约谈的基本梳理,其中主要阐述了行政约谈的概念、法律属性、功能、内容要素等基本知识,这些内容的梳理厘清了环境行政约谈制度的相关基础,为全文的展开做好了铺垫;其中行政约谈的法律属性定位是本章的一个核心内容,将行政约谈定性为非强制性行政行为,该属性确定为全文的展开奠定了基本基调。第二章紧接着第一章的行政约谈梳理,阐述了环境行政约谈制度的现实生成,集中描述了环境行政约谈制度的形成、理论基础与现实需求。通过考察,民主行政理论、均衡论、新的公共管理理论的发展是行政约谈的产生的理论基础,环境行政约谈作为行政约谈的一部分,也是建立在这一基础之上的;但突出的环境问题亟需新的环保执法模式,走出现实困境是环境行政约谈制度诞生的现实原因,这是一种现实驱动力,也是环境行政约谈制度的现实意义之体现。第三章是环境行政约谈制度的现实问题,通过对于相关制度的实践考察,发现主要表现在三个层面:一是制度供给问题,主要是行政约谈缺乏统一规范框架的影响和现实立法的不统一;二是制度内容缺陷,主要体现在约谈适用范围过窄、缺乏程序规范两个方面;三是制度运行异化,主要包括偏离非强制性轨道、行政机关滥用行政约谈、救济途径缺失等问题。第四章是环境行政约谈制度的完善路径,主要从树立正确的理念和原则、从环境行政约谈的立法着手加强环境约谈的制度供给、完善环境行政约谈的制度内容、健全环境行政约谈制度的运行机制等方面入手,期望通过这样一系列的完善措施可以弥补现实不足,实现环境行政约谈制度的法治化。通过完善环境行政约谈程序和对行政相对人的救济,规制行政主体权力,让环境行政约谈真正成为一项惠国惠民的法律制度。

  • Administrative interview is becoming more and more popular in the public administration with the advantages of non-obligatory,gentleness and negotiability and in recent year,it has gradually become a regulation in environmental law enforcement.Of course Administrative interview about the environment protection not only accord withed with the target of service-oriented government,but only made a new way for Law enforcement in the aspect of environmental protection.Environment Administrative interview is getting More and more recognition from the department of environment administrative law enforcement.But Administrative interview is the innovation in the aspect of legal system with undefined nature,so for it,there are many controversial issues and the new environment administrative interview system was also restricted by the old pattern.On the other hand,in recent year,many documents which were published by The central government and local government refer to the Administrative interview and even specialized environment interview system was made out,which has great difference with its feature of nondeterminacy.So there is the content query form the mass and mass it was very popular.Under such environment,the paper will make the analysis.In order to make the comprehensive study on the system of environment administrative interview.The paper will make the analysis form four aspects:In the first chapter,the writer made the basic arrangement for administrative interview.He mainly stated the basic knowledge,such as the concept of administrative interview,the legal attribute,function and contents,which helped us know the relative basis about the system of environment administrative interview and lay the basis for the analysis of whole paper.Among them,the position for the legal attribute of administrative interview is the core content in this paper which made the administrative interview as the administrative behavior with non-obligatory.The confirmation for such attribute laid the foundation for the statement of the whole paper.In the second chapter,following the arrangement for the administrative interview,the writer stated the its form in really world and pay attention to descript the form,theory basis and realistic demand for the system of environment administrative interview.By the investigation,the development of democratic administrative theory,equilibrium theory and new public management are the theoretical basis for the form of administrative interview.As a part of administrative interview,environment administrative interview was established on this basis.But environmental problem which is prominent desiderated the law enforcement pattern in the aspect of environmental protection.Walking out of the realistic difficulties is the realistic reasons for the forming the system of environment administrative interview.It is realistic driving force and the reflection practical significance of the system of environment administrative interview.The main content of the third chapter is about the real problems of the system of environmental administrative appointment.Three level of expression are discovered by researching on the relating system:The first problem is the problem of system supplies.The main content of the problem is the influences of lacking a united regulation framework of administrative appointment and the different real legislation.;The second is the shortcoming of content is that the range of appointment is narrow and lacking of regulation;The third is the dissimilation of operating system.The main content of the dissimilation is about the wrong compulsory pathway,misuse of authority of administrative institutions and lacking of methods of support and some other problems.The improving measures of environmental administrative appointment are discussed in the fourth chapter which contains the following parts: right ideas and rule,system supplies of environmental administrative appointment,improving the system content of environmental administrative appointment,perfect the operating system of environmental administrative appointment.The author hopes that the real shortcomings can be corrected and making laws for environmental administrative appointment by a series of improving measures.Environmental administrative appointment can benefit people by perfecting its procedure,supporting relating parties,building a system which can limit the power of administrative body.
