"为他人谋取利益"作为受贿罪的构成要素之一,需要结合其与其他构成要件之间的关系予以重新审视。基于受贿罪的客体与核心特质,"为他人谋取利益"不能归属于客观要件,否则难以与受贿罪权钱交易的本质特征相契合。在此前提下,把"为他人谋取利益"作为主观的超过要素,仍然面临着令人尴尬的司法处境,在功能运用与程序证明层面都有明显的不协调之处。"利用职务上的便利"在客观方面强调的是权钱交易而非"为他人谋取利益";在"索贿"与"收贿"中区别对待"为他人谋取利益",既没有理论根据也无实际必要。

  • Acted as a composing qualification in bribery crime,the factor of "figure for interest for others"shall be reviewed with the relationship among the qualifications of bribery crime. Firstly,the factor of "figure for interest for others"shall be subjective element,which accords with the essential characteristic of the object of bribery crime. Secondly,the factor of "figure for interest for others"is not exceed-subjective factor that will result in lots of out of line in function and proceeding. Thirdly,the factor of "figure for interest for others pays attention to the relationship between duty and blackmailing or receiving bribe,so differentiating that factor in the blackmailing or receiving bribe has no theoretical foundation or practical meaning.
