《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》第249条和第250条对特定继受人程序保障方面的规定比较简单,存在异议陈述权和程序救济权缺失、不同情形下诉讼费用分配不明、诉讼地位定位不清、善意取得受让人保护程序欠缺、法院对参加申请的审查程序模糊、转让人附随义务履行的缺失等问题。针对以上问题,我国特定继受人程序保障制度可以分别从基准时之前和基准时之后进行完善。

  • Although the 249 th and 250 th articles of " the Interpretation of Civil Procedure Law" provide a brief stipulation for the special litigation succeeding system,the specific litigation successor rights is still quite rudimentary. There are still some problems including the existence of the right of dissenting statement and the lack of procedural relief,the unclear allocation of litigation costs in different cases,the unclear position of the lawsuit,lack of protection procedures for the bona fide acquisition of the assignee,the court blurred the review procedure for the application,loss of the assignor' s compliance with the obligation etc. China' s specific litigation successor program guarantee system can be perfected from above two aspects before and after the benchmark time.
