Forensic psychiatry of china has been the absence of legal spirits and belief for a long time. On the basis of above deficiency, there are two existing problems in the factual exercise of law. First, non - medicine persons cannot entirely understand the testimony of psychiatrists. Secondly, psychiatrists assess capacity to criminal responsibility by medical insanity; instead they do by legal insanity.
