摘要：

数据主权作为国家主权在大数据时代的延伸与扩展,经历了媒介主权到网络主权再到数据主权的三重嬗变,承载着防御黑客攻击和捍卫国家安全的重要使命,暗含着对抗数据霸权主义和争抢国际话语权的大国博弈,还包括挖掘数据资源中蕴藏的经济利益和政治价值等内容。后棱镜时代的国家安全焦虑和跨国数据流动的客观必要性,需要构建风险预防与价值挖掘并行的规范制度,在重点防范核心数据资源泄露的同时,鼓励非核心数据的自由流通,形成数据本地化存储制度和关键基础设施保护制度,增强大数据领域的国际影响力和竞争力,为消解数据霸权主义和重构人类命运共同体贡献中国智慧。

  • As an extension and expansion of national sovereignty in big data era,data sovereignty has undergone three changes from media sovereignty to network sovereignty and data sovereignty,bearing the important mission of guarding against hackers and defending national data security. There is a superpower game between data hegemonism and international discourse. It also includes mining the economic interests and political value in the data resources. In the post-prism era,the anxiety of national security and the objective necessity of transnational data flow need to construct a parallel normative system of risk prevention and value mining,which focuses on preventing the leakage of core data resources while encouraging the free circulation of non-core data. The formation of localized data storage system and key infrastructure protection system will contribute China's wisdom to the deconstruction of data hegemonism and the reconstruction of data destiny community.
