户外广告牌整治法律问题研究

改革开放以来,我国市场经济迅速发展,企业竞争意识不断增强,户外广告业得到快速发展。户外广告在繁荣经济和传递商品信息的同时,也给城市和社会带来许多问题和困扰。为解决户外广告问题,全国各地掀起一股整治户外广告的浪潮。其中,整治户外广告牌所涉及到的经济利益巨大,专业性要求更高,引发的社会矛盾和争议更多,本文便以户外广告牌整治作为研究规制对象。户外广告牌整治虽在短期内取得显著成效,但也在一定程度上威胁到了户外广告业的生存,且由于相关措施未能从根源上解决问题,往往整治之后,户外广告牌乱象又会反弹。对此,社会各界给予高度关注并提出了质疑。为了保障户外广告业的健康发展,保护户外广告企业的合法利益和维护社会大众的权益,有必要从法律角度来研究解决户外广告牌整治问题。本文从郑州市、温州市户外广告牌整治案例出发,分析户外广告牌整治中存在的问题,借鉴国外发达国家户外广告的监管经验和做法,拟对户外广告牌整治中的问题提出法律对策和建议。   本文除引言和结语外,共包括四个部分:   第一部分以温州、郑州两地户外广告牌整治为例分析得出户外广告牌整治中存在的主要问题,包括以下四个方面:第一,户外广告牌整治主要采行“一刀切”模式;第二,存在“运动式”整治的问题;第三,实地执法不规范;第四,整治救济难落实。   第二部分探究户外广告牌整治问题存在和产生的深层次原因,力求从根源上解决户外广告牌整治问题。具体包括:立法方面,立法形式和内容不完备;执法方面,缺乏长效的监管机制,执法人员缺乏正确的执法理念,职业素养和专业水平差;监督方面,缺乏户外广告牌整治的再监管制度。   第三部分介绍国外发达国家户外广告监管的经验,并与我国的户外广告监管制度相比较,总结得出对我国立法和制度构建的启示。   第四部分针对上述问题和原因提出解决对策。从整体而言,我国需要健全户外广告牌整治法律法规体系,进行户外广告牌整治机制的改革和重构。具体对策包括:第一,健全户外广告牌整治法律体系;第二,改善户外广告牌的整治执法;第三,构建户外广告牌整治的再监管制度。

  • Since the reform and opening up, with the rapid development of market economy and enhancement of enterprises’competive consciousness, the outdoor advertising has developing rapidly. However, while brings economic prosperity and conveys commodity information, it causes problems to society at the same time. All parts of the country set off a wave of outdoor advertising regulation for solving the problems of outdoor advertising. Regulate outdoor billboards involves the huge economic interests, more professional knowledge, more social contradictions and disputes.So this article puts outdoor billboards regulation as the main research object of regulation.Though the regulations achived results in short period, but it did also partly threaten the survival of outdoor advertising. And, because of relevant measures fail to recognise and solve problems from the sources, the mess phenomenon usually rebound after regulation. It is necessary to study and solve the problems of outdoor billboards regulation from legal perspective, in order to ensure healthy development of outdoor advertising and protect rights and interests of enterprises and public. This paper starts from two cases of theme aforesaid of the provinces of Zhengzhou and Wenzhou, then by analyzing the problems existed in regulating outdoor billboards, and learning from experiences of developed countries, forwards some suggestions and solutions.    Besides preface and epilogue, this paper includes four parts.    The first part takes the cases of the provinces of Zhengzhou and Wenzhou as example, reaches the conclusion of problems exist in outdoor billboards regulation, which including the following four aspects. First, outdoor billboards regulation mainly adopted “one size fits all” mode; Second, theadverting regulation mainly adopted “sports type”regulation problems; Third, the field implementation lacks of standardization; Fourth, regulating-related relief measures are difficult to implement.    The second part mainly analyzes the underlying reasons of reflected by the problems existed in outdoor billboards regulation, aiming at solving the problems by exploring the sources of causes of the problems.includes: The legislative aspect, the incompletion of legal’s form and content; Law enforcement aspect, lacks of correct concept of law enforcement, professional quality and professional level, long-term supervision mechanism;The supervision aspect, lacks of the re-supervision system of outdoor billboards regulation.    The third part shows the experices of typical developed countries in outdoor advertising legislation and self-discipline of the industry, concluded for legislation and system construction of our country for reference. The fourth part puts forward the countermeasures according to the said problems, causes and experiences. Generally speaking, our country needs to consummate the outdoor billboards laws and regulations system, and Reform and reconstruction of the outdoor billboards control mechanism. Concrete counter measures included: First, establish a thorough outdoor billboards law system; Second, improve the law enforcement of outdoor billboards regulation; Third, construct the re-supervision system of outdoor billboards regulation.
