内容摘要辞职权是劳动者的一项法定权利,是劳动者自由择业的重要保障。但对于飞行员来说,行使辞职权可并不是一件容易的事情。通过中国裁判文书网搜集最近几年的劳动辞职争议案例,每年都有近百起飞行员与航空公司的劳动辞职纠纷案件且案件复杂。经笔者案例统计仅2014年就有将近75%的案件经过了二审审理,案件当事双方争议较多,比如双方是否能解除劳动合同、飞行员是否应支付巨额赔偿金以及航空公司是否应对飞行员技术档案和健康档案进行转交等。由于现行法律存在缺失以及行业规章与现行法律的冲突,从而在解决此类案件的司法实践中存在不少争议,导致此类案件判罚尺度不一的情形十分严重。本文通过选取最新典型案例,运用规范分析、文献分析和比较分析等方法逐一针对案件焦点进行分析,力图丰富和完善《劳动合同法》的有关理论,并为司法实践提出建议。本文共分为六个部分,主要内容如下:第一部分,对选取典型案例——赵义举诉中国东方航空股份有限公司浙江分公司案进行介绍,归纳本案的争议焦点,并引申出与之密切联系的相关问题。第二部分,分析飞行员是否具有劳动者身份。首先,对劳动者的内涵进行阐述,得出认定劳动者的关键为是否具有从属性。通过分析人格从属性以及经济从属性,确定飞行员具有劳动者身份。随后,对飞行员的特殊性进行分析,认为这些特殊性并不会对其劳动者身份构成任何否定性影响,但飞行员是特殊的劳动者,较一般劳动者具有一定的优势地位。第三部分,分析飞行员是否享有自由度极大的辞职权。首先,对劳动者辞职权的内涵进行阐述,然后结合我国现行法律对辞职权的有关规定分析辞职权的立法理由,以此为基础得出飞行员应当享有辞职权的结论。最后,结合本案对飞行员行使辞职权在程序上的要求以及法律效果进行分析。第四部分,分析飞行员辞职是否应该赔偿,航空公司是否可以索取巨额赔偿中:首先,通过劳动者对用人单位的赔偿责任进行阐述,分析劳动者在何种情况下需要对用人单位承担赔偿责任,并对劳动者的违约金和赔偿金性质进行分析。其次,针对本文讨论的主题,对飞行员服务期约定的合理性进行分析,包括对劳动者服务期内涵和存在的必要性以及飞行员与航空公司约定服务期期限存在的问题。最后,通过对劳动者赔偿的法律依据进行论述,确定飞行员违反约定辞职所需要赔偿的具体标准,并对目前司法实践中所存在的问题进行评价分析。 第五部分,分析航空公司是否应该为飞行员办理相关档案转交。阐述劳动合同中用人单位有哪些后合同义务,确定用人单位有为劳动者办理相关档案转移的后合同义务,航空公司亦不例外。最后,在结语部分,综合上述研究,针对《劳动合同法》在调整飞行员与航空公司的辞职纠纷中所暴露的问题以及司法实践过程中所存在的问题,提出个人完善建议。

Because of the lacking of current law and industry regulations conflict with current law, to solve this kind of case in the judicial practice exist some disputes, Disputes in such cases have different foreign situation is very serious .By choosing the latest typical cases, this article makes use of normative analysis, the method of literature analysis and comparative analysis one by one, focus on case analysis. To enrich and perfect the theory of "labor contract law", and put forward to build for the judicial practice. This article is divided into six parts, the main content is as follows: The first part, the selection of typical cases - The Case of Zhao Yi Ju sue Zhe Jiang Branch of China Eastern Airlines, summing up the case of disputes, and extended the close contact with the related problems. The second part, analyzing whether the pilot has workers identity. First of all, expounds the connotation of the laborer, concluded that the key to whether has the properties of the workers. Secondly, in view of the topics discussed in this article, analyzes the rationality of the pilot service agreement, including service connotation and the necessity of the existence of laborers and the pilot with the airlines contract problems existing in the service period. Finally, through to the workers compensation law, determine the specific standard of pilot breached the contract, to resign need to compensate for, and makes an analysis of the existing problems in the judicial practice. The fifth part, analyze the airlines should transfer for pilots to handle the related files. Expounds what unit of choose and employ persons in the labor contract after the contract obligation, determine the unit of choose and employ persons for workers to handle related files transfer after the contractual obligations, the airline is no exception. Finally, in the conclusion part, comprehensive the above research, in view of the "labor contract law" in the adjustment of the pilot with the airlines to resign disputes in the exposed problems in the process of the judicial practice and the existing problems, to put forward to individual improvement Suggestions .
