内容摘要保险在提高经济发展水平、提升社会文明程度和完善社会治理能力上起着重要的作用,它不仅是市场经济的重要组成部分,更是防范风险的重要手段。进入二十一世纪后,我国保险保费收入水平显著提高,保险业飞速发展。与我国保险业的快速发展相比,保险法律制度建设显得相对滞后,特别是与保护保险消费者权益相关的法律制度,缺乏完善的法律体系和有效的救济机制。目前,我国保险行业存在诚信缺失、保险监管不到位、保险消费者自身保护意识单薄等问题,这些问题直接导致误导销售和理赔困难等侵犯保险消费者合法权益的行为在我国保险市场中大量涌现。对此,尽管我国采取了一系列的措施并取得了一定的成效,但是,从2014年12月31日我国保监会通报的保险公司虚假违规宣传案、误导销售案、无理拒赔案等近两年查处的侵害保险消费者合法权益的典型案例,能够看出我国对保险消费者权利的保护仍有许多问题存在。我国保险业正处在发展的关键期,保险消费者作为保险业持续发展的前提和根本,对其权益保护的研究已经成为了一个重要课题。我国针对保险消费者权益保护的研究始于21世纪初,诸多专家学者对此提出了自己的观点和见解,推动了保险消费者保护领域理论与制度的发展。但通过对保险消费者权益保护的现有研究比较和分析,笔者发现,绝大多数研究几乎都围绕于保险监管和立法上,对于保险消费者的基本概念尚未明确界定。因此,为了更好的发挥保险消费者权益保护法律制度在保险业持续健康发展中的作用,应在借鉴域外先进的法律制度和监管经验的基础上,探索建立并完善我国保险消费者权益保护的法律制度。本文从保险消费者基本理论出发,结合近年来发生的损害保险消费者权利的典型案例,引出我国保护保险消费者权益上存在的问题和现状,同时对其原因进行深入剖析;并借鉴相关域外先进的法制经验,针对我国保险消费者权益保护法律制度存在的问题提出围绕立法、监管和消费者自我保护意识等方面的合理建议。本文的研究内容分为四部分:引言部分通过论述关于保险消费者权益受侵害的两个案例,引出本文的议题。同时还论述了本文的研究现状、内容、方法以及本文的亮点和不足之处。第一部分主要是对保险消费者基本理论进行详细论述,包括对本文所涉及的保险消费者和保险消费者权益等基本研究范畴进行相应界定,并讨论说明了保险消费者权益保护的原因和意义,从而给后文的论述提供了理论依托。第二部分主要是由一些案例来分析我国保险消费者权益保护法律制度目前运行的状况,并对保险消费者权益受侵害情况进行类型和原因分析。第三部分主要是对包括英美日在内的域外保护保险消费者权益的法制发展状况进行介绍,并针对我国存在的问题,提炼出我国应该借鉴的措施。第四部分主要是提出解决我国保险消费者权益保护法律制度的方法和举措。以存在的问题为导向,从四个不同的方面提出解决办法:第一,推进保险消费者权益保护立法;第二,健全保险消费者权益保护监督管理模式,更新相应的理念;第三,完善法律救济程序;第四,提升保险消费者自身保护意识。关键词:保险消费者;保险消费者权益;消费者保护;监管制度

  • AbstractInsurance plays in raising the level of economic development, enhance the degree of social civilization and improve social governance on an important role, it is not only an important part of the market economy, but alsoan important means to prevent risks.The twenty-first century, China's insurance premium income was significantly improved, the insurance industry has developed rapidly. Compared with the rapid development of China's insurance industry, various types of insurance legal system construction appears lagging, especially with the protection of consumer rights related to the insurance of the legal system, the apparent lack of a complete legal system and effective relief mechanism.The current, there is a lack of good faith in China's insurance industry, insurance regulation is not in place, the insurance consumer awareness of self-protection thin and other issues, which directly lead to behavioral difficulties misleading sales claims and violations of the legitimate rights and interests of insurance consumers in large numbers in China's insurance market . In this regard, although China has taken a series of measures and have achieved some success, but from the insurance company violations of false propaganda text December 31, 2014 notification of the CIRC, the mis-selling cases, unreasonable exclusions case, nearly two years typical case investigation against the legitimate rights and interests of insurance consumers, can be seen on the protection of the rights of insurance consumers are still many problems.China's insurance industry is in a critical period of development, the insurance consumer the insurance industry as a prerequisite for sustainable development and fundamental research of its rights protection has become an important issue. Our study of the insurance consumer protection began in the early 21st century, many scholars have put forward their views and opinions, and promote the development of the insurance consumer protection Theory and System. But consumer protection through insurance comparison and analysis of existing research, I found that the vast majority of research on almost all around the insurance regulatory and legislative, not yet clearly defined the basic concept of insurance consumers. Therefore, in order to better play the role of the insurance consumer protection legal system in the insurance industry sustained and healthy development, should learn from advanced extraterritorial legal system and regulatory basis of experience, and explore the establishment and improvement of China's insurance consumer protection Legal System.In this paper, the basic theory of the insurance consumer, combined with accident insurance consumer rights typical case occurred in recent years, leads to problems that exist on the current situation and to protect the interests of the insurance consumer, but the reason for this in-depth analysis; and draw on relevant advanced extraterritorial legal experience, put forward reasonable proposals around legislative, regulatory and consumer awareness of self-protection against other aspects of China's insurance consumer protection problems in the legal system.Contents of this paper is divided into four parts:Introduction part through discussing two cases about violations of the insurance interests of consumers, leads to the subject of this article. It also discusses the status of this research highlights, content, method and article and shortcomings.The first part is the basic theory of consumer insurance discussed in detail, including basic research areas of insurance consumers and the insurance consumer rights and interests referred to herein accordingly define, explain and discuss insurance consumer protection reasons and significance, giving the later discussion provides a theoretical support.The second part is the status of China's insurance consumer protection legal system currently in operation by a number of cases to analyze, and the insurance consumer rights infringement cases for type and cause analysis.The third part is outside the protection of the interests of consumers of insurance including the development of the Anglo-American legal system, including the date introduced, and the problems in our country, to extract the measures China should learn from them.The fourth part is to propose solutions and measures of China's insurance consumer protection legal system. Oriented to the problems, propose solutions from four different aspects: first, to promote the insurance consumer protection legislation; second, improve the supervision and management of the insurance consumer protection mode, update the corresponding concept; third, perfect remedy procedure; fourth, to enhance the insurance consumer self-protection awareness.Key words:Insurance consumers; the insurance consumer rights; consumer protection; regulatory regime
