摘要:

信访制度作为一项极具中国特色的制度设计,自1951年创设以来,在民意表达、权利救济、矛盾化解、权力监督等方面发挥着举足轻重的作用,是保障社会和谐稳定的“安全阀”。近年来,一大批群众的合理诉求得以妥善解决,不少信访老户经教育也已息诉息访,信访总体形势开始向良性方面转变,但实践中由于一些客观或主观的社会因素影响,少数信访人心态失衡,“信访不信法”“信利不信理”“信上不信下”,为了合理或不合理的信访诉求滥用信访权利,不按法定程序、不到指定场所、不以法定方式到有权处理信访事项的机关或组织提出诉求,而是采取蓄意的、过激的、相关法律法规明确限制或禁止的手段重复上访、缠访闹访、越级上访、群体上访,严重扰乱信访秩序、工作秩序和社会秩序,损害了政府公信力和法律权威,极易产生“劣币驱逐良币”的不良示范效应。因此,如何有效治理违法信访行为,引导信访者回归依法、逐级、有序、理性信访的常态,是全面依法治国进程中的重点也是难点。本研究以整体性治理理论、越轨与博弈理论、法社会学理论为基础,在明确界定和区分“非正常信访”与“违法信访”这两大核心概念的内涵和外延基础上,深入阐释违法信访行为的特点及其危害,全面梳理违法信访行为治理的相关制度依据,借鉴地方依法治访的实践经验,从目标导向、制度规范、机制创新、技术应用、责任履行五个层面提出了完善违法信访行为的整体性治理路径。目标层面坚持以人民为中心,切实解决访民合理合法的利益诉求;制度层面关注统一的《信访法》、分类处理制度、信访终结制度的制定和落实,机制层面倡导心理调节、部门联动、公开评议、失信惩戒、价值平衡机制创新,技术层面强调“智慧信访”大数据分析平台、ODR在线矛盾纠纷化解平台、信访指数应用系统的运用,责任层面注重增强群众和信访干部运用法治思维和法治方式信访和治访的自觉、责任与能力,以期契合信访风险治理的新要求,形成共建共治共享的新格局,提升信访治理和社会治理现代化水平,促进法治政府和法治社会建设,不断增强人民群众获得感、幸福感、安全感。违法信访行为治理是一项长期且复杂的系统工程,并非一蹴而就。我们必须坚持以整体性治理思维推进依法信访、依法办访、依法治访,落实“三到位一处理”,才能从根本上减少违法信访行为,充分发挥信访制度的应有功能。

  • As a system design with Chinese characteristics, the petition system has played an important role in public opinion expression, right relief, contradiction resolution and power supervision since its establishment in 1951. In recent years, a large number of reasonable demands of the masses have been solved properly, lots of entangled petitioners through education have stoped petitioning, the general situation of petition has begun to change to positive aspects, but in practice, because of some objective or subjective social factors, a few petitioners are out of balance, “trusting petition rather than law”“trusting profit rather than reason”“trusting superior rather than suberior”, in order to reasonable or unreasonable petition demands abuse petition rights, not according to the legal procedure, specified place, or the legal way to appeal to an organ or organization which has the right to handle petition matters. on the contrary, they repeatedly petition, kinkily petition, leapfrogged petition and collectively petition by the deliberate, ultra, relevant laws and regulations expressly restricted or prohibited means, Seriously disturbing the petition order, work order and social order, damaging the credibility of the government and legal authority, and very easily producing bad demonstration effect like “bad money drives out good”. Therefore, how to effectively govern illegal petition behavior and guide petitioners to return to the normalcy of lawfully petition, step by step petition, orderly petition, rationally petition are the key and difficult points in the process of comprehensively implement the rule of law. The research according to the holistic governance theory, deviance and game theory, legal sociology theory as the foundation, based on a clear definition and distinguish the connotation and extension between “abnormal petitioning” and “illegal petitioning”, deeply elucidates the characteristics, reasons and harms of illegal petition behavior, comprehensively sorts out the system basis related to the governance of illegal petition behavior, learns from the practical experience of governing petition in accordance with law, puts forward improving the holistic governance path of illegal petition behavior from the five aspects of objective orientation, institutional norm, mechanism innovation, technology application and duty performance. The objective level should persist in people-centered concept and earnestly solve the reasonable and legitimate interest demands of petitioners; the institutional level focus on improving and implementing the petition law, classification processing system and closing petition system, etc; the mechanism level advocates innovation about psychological adjustment, departmental linkage, hearing deliberation, punishment for break faith and value balance mechanism; the technology level emphasizes the use of “smart petition” big data analysis platform, the online disputes resolve platform and petition index application system; the duty level pays attention to enhance the masses and cadres’consciousness to petition and govern petition with the rule of law thinking and ways, expecting to fit into the new requirements of petition risk governance, form a new pattern of co construction, sharing and sharing, promote the level of modernization in petition governance and social governance, propel the law-based government and society ruled by law construction, constantly increase people's sense of gain, well-being and security.Illegal petition behavior governance is a long-term and complex system project, which is not accomplished overnight. We must hold on the holistic governance thinking to advance lawfully petition, lawfully handle petition and lawfully govern petition, implement “three in place and one in processing”, in order to fundamentally reduce the illegal petition behavior and give full play to the function that the petition system should have.
