摘要：

贫困人口退出作为脱贫攻坚的最后一环,正面临"被脱贫"及"消极脱贫"交互影响下产生的异化风险,需要借由法律激励的制度创新以推进其命令控制范式的转换。以近年来中央和地方有关文件为统计对象,分析现有法律激励制度的不足,探寻增加贫困人口预期权益、包含多元客体、具有"契约特性"、注重外在激励的贫困人口退出法律激励路径,以引导贫困人口在自主退出的基础上助力扶贫事业的顺利完成。

  • As the final step of poverty alleviation,the poverty exit of the poor has been facing the risk of alienation caused by "forced exit"and "negative exit",Innovation of the legal incentive system is required to promote the transformation of the imperative-control paradigm of the exit mechanism. This essay analyzes the deficiencies of the existing legal incentive system based on the statistics of relevant documents of the central and local governments,and explored a path of legal incentive,including the increase of the expected rights of the poor,multiple objects,the focus of contractual characteristics and external incentive,which is used to contribute to the success of poverty alleviation on the basis of leading the poor to exit from poverty positively.
