区域法治是针对区域性问题因地制宜地加强法治建设,以强化其法治保障力度和效果,最终实现善治的法治形式。"一带一路"沿线国家和地区组合成的诸多区域存在一系列区域治理问题,它们构成了"一带一路"倡议实施的主要载体和基本内容。通过加强法治保障,特别是通过加强区域法治建设达致善治,从而促进和维护"一带一路"沿线国家和地区之间的政策沟通、设施联通、贸易畅通、资金融通、民心相通。"一带一路"倡议背景下的区域法治建设情况复杂、层次较多、类型各异,需要实事求是地进行深入细致的研究和分析;其内容和形式丰富多彩,应当分阶段、有计划、有步骤地开展,分轻重缓急以循序渐进。此外,推进"一带一路"倡议背景下的区域法治建设还要处理好与沿线国家和地区法律制度、相关国际法和相关区域政策之间的关系。

  • Regional rule of law construction,intended to strengthen the means and effect of rule of law according to the local realities,plays an important role in achieving the overall good governance in a region.The countries and regions along the routes of the Belt and Road Initiative,to some extent,form an area where cross-border goverance is inevitable and the regional goverance at issue is the major medium and basic content of implementing the B&R Initiative.It is necessary to strengthen the rule of law and in particular the regional rule of law so as to achieve good governance,which will promote and maintain the effective communication or connection between the countries and regions concerned in terms of polocy,infrastructure,trade,investment and mutual understanding and respect among people in different countries.Regional rule of law development in this regard is so complicated in level and type that it is neccessary to conduct in-depth and detailed investigations and analyses.Its richness in both content and form means that it should be implemented in a well-planned and step-by-step way.Furthermore,it is necessary to handle appropriately the relationship between the promotion of regional rule of law and the regional legal systems,the relevant international laws and the regional policies.
