摘要：

我国人口老龄化问题正逐步加剧,由于"养儿防老"的基础功能日益弱化、"社会养老"保障体系尚不完善,"以房养老"模式应运而生。虽然这一模式的推行有一定的政策保障和物质基础,但也面临着遗产继承条款的限制、"禁止流押"的限制和土地使用权期限的限制等法律困境。应完善遗产继承条款、解禁流押条款、完善土地使用权续期制度,同时加强政府的规范引导,使"以房养老"得到更好更广的推行。

  • China is conf ronted with aggravating a geing population. Increasingly weakening of basic function of child-rearing-based care for the aged and the defective security system for social pension give birth to house-based pension model, which is still confined to inheritance provisions, the ban on mortgage transfer and the deadline for land-use rights despite its policy guarantee and material foundation. Accordingly, efforts need to made to improve the inheritance previsions, lift the ban on mortgage transfer, and improve the renewal system for land-use rights,meanwhile, strengthen the government's normative guidance so as to better practise house-based pension.
