中国古人对优良法制的孜孜追求,塑造了传统中国良法观的深厚底蕴与完整逻辑。从法哲学的视角来看,传统中国的良法观主要关注"良法是什么"、"法律为什么被认定为良法"以及"如何证成法律是优良"三个主要问题。对传统中国良法观的法哲学逻辑进行梳理,有助于我们深刻理解中国法律传统在当代的影响及其作用,有助于更好地以良法保障善治。

  • The Chinese ancients' pursuit of the legal system has shaped the profound connotation and logic of the traditional Chinese concept of good law. From the perspective of legal philosophy, the traditional Chinese concept of good law mainly focuses on what good laws are, why laws are recognized as good laws and how good laws are proved. It is helpful for us to understand the influence and role of Chinese legal tradition in the contemporary era that we understand the logic of legal philosophy of traditional Chinese good laws and it is helpful to guarantee good governance with good laws.
