大数据证据是记载对海量电子数据进行分析后所获得的结论的材料。在司法实践中,大数据证据主要包括三种情形:用来证明涉案人员活动轨迹的大数据证据;用来证明有组织犯罪案件中涉案人员组织架构的大数据证据;用来证明涉案金额的大数据证据。大数据证据的证据种类应当根据具体情形做具体分析。大数据证据具有衍生性、科技性、间接性以及它与镶嵌论的契合性等特点。作为一种新型证据,对大数据证据的审查判断在方式和内容上均存在有别于其它证据之处。

  • Big data evidence is the material which records the conclusion after analyzing the massive electronic data. In judicial practice, big data evidence is mainly applied in the following three situations: to prove the track of the people involved in the case; to prove the organizational structures of the people involved in organized crimes; and to prove the amount of money involved in the case. The types of big data evidence should be analyzed according to the specific situations. Big data evidence has the characteristics of derivation, science and technology, indirectness and fit with mosaic theory. As a new type of evidence, the examination and judgement of big data evidence is different from that of other evidences in both ways and contents.
