南京国民政府时期,监察法制的变迁影响着监察权的配置与行使。从"善治"的理念出发,拓展既有成果中制度梳理和统计分析的视野,聚焦监察案例和档案资料,辅以监察权的宗旨与目标、运行效果与社会舆论为绩效评估参照系,检视各项监察权的运行实迹,分析、探讨其在反腐肃贪、人权保障等方面的具体成效,斟酌政治环境、官场积习、人员素养和配套机制上存在的制约因素。这除了有利于加深对于民国监察权的性质和定位的认识外,亦为当今监察体制改革与实践提供镜鉴。

  • During the period of the Nanjing National Government, the changes in the legal system affected the allocation and exercise of supervisory power. Starting from the concept of "good governance", this paper will expand the research perspective of institutional review and statistical analysis, focus on cases and archives, and use the purpose and objectives ofsupervisory power, operational effects and public opinion as the performance evaluation reference system, and examine various the operational reality of the power of supervisory, analysis and discussion of its specific effects in anti-corruption, human rights protection, etc., and resolving the constraints of the political environment, official habit, personnel literacy and supporting mechanisms. In addition to deepening the understanding of the nature and positioning of the supervisory power of the Republic of China, it also provides a reference for the reform and practice of the national supervisory system.
