科学认识中国传统法律文化是建设"新时代中国特色社会主义法治国家"的重要前提。三十多年来,以《"法"辨》为代表的"中西法文化二元"认知范式,制约了人们对中国传统法律文化的认识水平。"中西法文化二元论"是在特定认知情境下,受特定认知条件和认知结构支配形成的观念型认知。"历史三峡"的时空情境是"中西法文化二元论"形成的客观原因,"西方中心"的知识依赖是"中西法文化二元论"形成的直接原因,"主体性丧失"是"中西法文化二元论"形成的根本原因。超越"历史三峡"的情境限制,可以获取中国传统法律文化认知的全景视角,摆脱"西方中心"的知识依赖,可以树立中国传统法律文化认知的主体立场,遵循"全景视角+主体立场"的认知理性,可以实现对中国传统法律文化的理性认知。包含着价值理性的和谐文化,形式理性的多元文化,纠纷解决的调解文化,官法同构的君子文化等在内的中国传统法律文化,不仅能够"回应中国现实""照应中国未来",而且能够"凝聚中国特色""彰显中国精神",是建设中国特色社会主义法治国家的文化渊源和智慧宝藏。

  • Scientific understanding of traditional Chinese legal culture is an important prerequisite for building a "socialist state of law with Chinese characteristics in the new era". For more than 30 years,the cognitive paradigm of "dualism between Chinese and Western legal culture " represented by "Legal Discernment"has restricted the level of people 's understanding of traditional Chinese legal culture. The"dualism of Chinese and Western legal culture"is a conceptual cognition formed in a specific cognitive context,governed by specific cognitive conditions and cognitive structures. The spatio-temporal situation of"historical three straits"is the objective reason for the formation of "Chinese and Western legal culture dualism",and the knowledge dependence of "Western center"is the reason for the formation of "Chinese and Western legal culture dualism". The "loss of subjectivity"is the fundamental reason for the formation of the"East-West legal-cultural dualism". By transcending the limitations of the"Three Gorges of History",we can obtain a panoramic view of traditional Chinese legal culture cognition,get rid of the "Western-centered "knowledge dependence,establish a subjective position of traditional Chinese legal culture cognition,and follow the "panoramic view + subjective position". Following the cognitive rationality of"panoramic view + subjective position",we can realize the rational cognition of traditional Chinese legal culture. The traditional Chinese legal culture,including the harmonious culture of value rationality,the pluralistic culture of form rationality,the mediation culture of dispute resolution,and the gentleman culture of the same structure of government and law,can not only "respond to the Chinese reality"and "take care of the Chinese future",but also function as a cultural source and a treasure of wisdom for building a socialist rule of law state with Chinese characteristics.
