摘要:

《〈联合国海洋法公约〉下国家管辖范围以外区域海洋生物多样性的养护和可持续利用协定》(Agreement under the United Nations Convention on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological Diversity of Areas beyond National Jurisdiction,以下简称“BBNJ 协定”)的达成,标志着国际社会在国家管辖范围外海洋治理领域迈出了重要一步,在中国推进海洋强国建设的背景下也极具现实意义。“适当顾及”义务是协调各国在国家管辖范围外区域行使权利与履行义务的重要规范工具。在BBNJ协定的谈判与制度设计过程中,该义务始终是各方关注的焦点,并贯穿于协定多项核心制度安排之中。鉴于国家管辖范围外区域的治理既需要与《联合国海洋法公约》(United Nations Convention on the Law of the Sea,以下简称“《公约》”)既有制度相衔接,又需平衡不同国家及其他相关主体间的利益,“适当顾及”义务在上述两方面均发挥着基础性作用。因此,对该义务的解释模式及实施路径的界定,将直接决定BBNJ协定生效后的运行实效。BBNJ协定已经生效,进入实施推进阶段,相关条款覆盖的适用场景和利益主体呈现复杂化趋势,“适当顾及”义务的适用不再局限于《公约》框架下以国家间关系为核心的传统结构,新治理语境里多国利益交织,制度机制多元,这一义务需要面对新的解释与适用挑战,本文围绕BBNJ协定中的“适当顾及”义务展开,梳理它的规范渊源与谈判演进过程,结合条约文本、评注资料及相关司法实践,分析该义务在不同制度情境中的具体指向与协调功能,探讨它在BBNJ协定实施过程中可能出现的履行问题,梳理对应应对思路,为中国推进BBNJ协定履约,落实协定下具体义务,维护国家海洋权益,完善全球海洋治理梳理参考方向。文章正文共包括四个部分,其中:第一部分围绕BBNJ协定中适当顾及规则的溯源与谈判进程展开,通过梳理BBNJ协定前海洋法条约体系中的在先规则框架,具体分析《公约》及《鱼类种群协定》中的“适当顾及”相关条款;再聚焦BBNJ协定谈判过程,重点剖析协定第11条、第22条、第43条中“适当顾及”条款的谈判历程,呈现不同国家的立场与主张,清晰揭示该义务在BBNJ协定中的发展脉络。第二部分重点阐释BBNJ协定中的“适当顾及”义务内涵,从义务的基本性质、义务的主体、义务所指向的权利主体以及义务的履行方式四个维度展开:明确“适当顾及”义务作为积极行为义务的属性;剖析该义务的主体;分析义务所指向的权利主体;细化该义务的具体履行方式,包括勤勉义务、多边协商与信息交换两种方式,为后续分析义务适用与履行困境奠定基础。第三部分聚焦BBNJ协定下“适当顾及”义务的履行困境,从三个层面系统分析实践中面临的主要困难:一是规范模糊性引发的适用困境,具体体现为适当顾及语义的开放性与客观适用标准的缺失;二是利益冲突背景下的协调困境,核心是沿海国与其他公海利用国之间的利益不对称,以及发展中国家实质参与的制度性不足;三是能力分化背景下的实现困境,主要表现为资金与技术支持机制的薄弱,以及履约能力差异带来的分配正义问题,并简要探讨各类困境的纾解思路,提升义务适用的可操作性。第四部分立足中国作为沿海国和发展中国家的双重身份,结合BBNJ协定生效后相关制度逐步推进的治理背景,明确我国在履行“适当顾及”义务中的基本立场与治理定位。在此基础上,围绕该义务在协定框架下的适用与落实提出相应路径建议,主要包括参与实施细则制定、完善国内法衔接以及提升履约能力建设三个方面,以期为中国推动BBNJ协定履约并在全球海洋治理中发挥积极作用提供参考思路。关键词:“适当顾及”义务;BBNJ协定;《联合国海洋法公约》;勤勉义务

  • The adoption of the Agreement under the United Nations Convention on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological Diversity of Areas beyond National Jurisdiction (hereinafter referred to as the “BBNJ Agreement”) marks a significant step forward for the international community in the governance of areas beyond national jurisdiction, and holds practical significance for China in the context of advancing its maritime power strategy. The obligation of “due regard” serves as an important normative instrument for coordinating States’ exercise of rights and fulfillment of obligations in areas beyond national jurisdiction. Throughout the negotiations and institutional design of the BBNJ Agreement, this obligation has remained a central focus of attention for all parties and permeates multiple core institutional arrangements of the Agreement. Given that the governance of areas beyond national jurisdiction requires both coherence with the existing regime under the United Nations Convention on the Law of the Sea (UNCLOS, hereinafter referred to as “the Convention”) and a balance of interests among different States and other relevant stakeholders, the obligation of “due regard” plays a foundational role in both respects. Consequently, the delineation of its interpretative models and implementation pathways will directly determine the operational effectiveness of the BBNJ Agreement after its entry into force.The BBNJ Agreement has entered into force and is now moving into the implementation phase. As the scope of activities regulated by the Agreement expands and the interests involved become increasingly diverse, the application of the due regard obligation faces new interpretative and practical challenges. This article examines the due regard obligation under the BBNJ Agreement by tracing its normative origins and evolution during the negotiation process. Based on treaty provisions, academic commentaries, and relevant judicial practice, it analyzes the structure, functions, and application of the obligation in different institutional contexts. The article further discusses potential difficulties in its implementation and proposes corresponding approaches for addressing them. The study aims to provide references for China’s implementation of the BBNJ Agreement, fulfillment of treaty obligations, protection of maritime rights and interests, and participation in global ocean governance.This article unfolds in four parts.Part I examines the origins and negotiating history of the due regard obligation under the BBNJ Agreement. It first reviews the relevant legal framework developed in earlier law of the sea treaties and analyzes the due regard provisions contained in the Convention and the Fish Stocks Agreement. It then focuses on the negotiation process of the BBNJ Agreement, with particular attention to the due regard provisions in Articles 11, 22, and 43. By examining the positions and proposals advanced by different States during the negotiations, this Part traces the development of the obligation and clarifies its evolution within the BBNJ Agreement.Part II focuses on the content of the due regard obligation under the BBNJ Agreement. It examines the obligation from four dimensions: its fundamental nature, the subjects bearing the obligation, the rights-holders toward whom the obligation is directed, and the means by which the obligation is to be fulfilled. Specifically, this Part clarifies the characterization of due regard as a positive obligation of conduct, identifies the subjects bound by the obligation, analyzes the rights-holders whose rights and interests are to be taken into account, and elaborates on two principal means of implementation: due diligence and mechanisms of multilateral consultation and information exchange. This analysis provides the foundation for the subsequent examination of the application of the obligation and the challenges arising in its implementation.Part III focuses on the challenges associated with the implementation of the due regard obligation under the BBNJ Agreement. It systematically examines the principal difficulties that may arise in practice from three perspectives. First, it analyzes interpretative challenges resulting from normative ambiguity, particularly the open-ended nature of the concept of due regard and the absence of clear objective standards for its application. Second, it explores coordination challenges arising from competing interests, with particular attention to the asymmetry of interests between coastal States and other users of the high seas, as well as the insufficient institutional support for the effective participation of developing States. Third, it discusses implementation challenges in the context of unequal capacities, including the limitations of existing financial and technological support mechanisms and the issues of distributive justice arising from disparities in implementation capacity. The Part also briefly considers possible approaches to addressing these challenges with a view to enhancing the practical operability of the obligation.Part IV examines the due regard obligation from the perspective of China’s dual status as both a coastal State and a developing country, taking into account the evolving governance context following the entry into force of the BBNJ Agreement and the gradual development of its institutional framework. It clarifies China’s basic position and governance orientation in implementing the due regard obligation. On this basis, the Part proposes a number of approaches for the application and implementation of the obligation within the framework of the BBNJ Agreement, focusing on three aspects: participation in the development of implementation rules and procedures, the improvement of domestic legal coordination, and the strengthening of implementation capacity. It aims to provide references for China’s fulfillment of its obligations under the BBNJ Agreement and its constructive participation in global ocean governance.
