摘要:

ESG实践并非一帆风顺。在可持续发展成为全球共识的今天,环境、社会和治理(ESG)理念日益重塑企业的评估框架与价值导向,也同我国经济高质量发展的要求和新发展理念高度契合。相较于发达经济体,我国在ESG领域起步略晚,但近年来在政策引导和市场激励的双重作用下,ESG在中国得到了迅速发展,倡导“义利并举”的ESG理念愈发受到社会各方重视。然而,不可忽视的现实情况是,ESG实践活动在短期内需要企业投入大量内部资源,且回报周期较长,使得企业决策者往往纠结于责任、利润的“两难选择”。与此同时,企业的ESG实践并非总是一帆风顺,或总能满足各方利益相关者的期望水平。当企业的实际ESG绩效未能达到利益相关者的预期水平时,易导致企业面临较大的合法性危机和声誉压力。组织期望理论认为,企业决策者受限于自身的“有限理性”,往往会根据历史绩效和社会绩效设定一个满意的期望目标,根据实际绩效与期望绩效的差距,评估企业经营表现,并据此调整企业战略目标与行动方案。当企业面临ESG绩效期望落差这一负面绩效反馈时,这种“穷则思变”的决策逻辑便会驱动企业开展问题搜寻,寻求能够快速提升ESG表现、改善经营业绩的战略选项。在此背景下,研究管理层如何调整经营决策以应对ESG绩效期望落差所带来的不利影响,是一个值得深入探讨的问题。已有文献多聚焦于企业通过实施“漂绿”行为、改变社会责任报告语调行为改善企业的外部印象,然而,从企业内部角度来看,作为更为普遍、直接和隐蔽的税收激进行为,却未得到充分讨论。税收是企业重要的一项成本支出,而税收激进行为降低了企业的税收成本,对业绩改善和公司价值提升有着积极作用。企业在制定避税策略时,既要考虑避税收益(如缓解现金流、满足经营实际需要),也要考虑避税成本(如受到稽查处罚、声誉受损的风险)。那么,在企业面临ESG绩效落差所带来的合法性压力与内部资源约束的情境下,企业的税收策略将何去何从?是通过税收激进行为以期迅速“补救”ESG绩效落差状况,抑或是出于对长期声誉、违规处罚的忌惮,从而更好地约束自身税收激进行为?鉴于此,本文利用2011—2024年沪深A股上市公司为研究样本,实证检验了ESG绩效期望落差对企业税收激进度的影响及其机制。研究发现:(1)当企业处于ESG绩效落差情境时,会显著加剧企业的税收激进行为;(2)机制检验的结果表明,ESG绩效期望落差通过增大管理层业绩压力、提升企业风险承担水平和加剧企业代理冲突,从而提高企业的税收激进度;(3)审计委员会独立性与财务专业性在ESG绩效期望落差与企业税收激进度的关系之间起到负向调节作用,即抑制企业因ESG绩效期望落差而产生激进避税的行为;(4)异质性分析结果表明,ESG绩效期望落差与税收激进度的正向关系在落差持续时间较长、征管水平较低、非重污染行业的企业中更加显著。(5)进一步检验的结果表明,ESG绩效期望落差维度中,社会责任与治理维度的绩效期望落差会引发企业激进的税收行为,而环境层面的绩效期望落差与税收激进度之间没有直接关联。

  • ESG practices are not always smooth sailing. In today's era when sustainable development has become a global consensus, the concepts of environment, society, and governance (ESG) are increasingly reshaping the assessment framework and value orientation of enterprises, and are highly consistent with the requirements of China's high-quality economic development and the new development philosophy. Compared with developed economies, China's ESG journey started a bit later, but in recent years, under the dual influence of policy guidance and market incentives, ESG has developed rapidly in China. The ESG concept, which advocates "a balance of righteousness and profit", has increasingly gained attention from all sectors of society. However, it is an undeniable reality that ESG practices require a significant investment of internal resources from enterprises in the short term, and the return cycle is relatively long, which often leaves enterprise decision-makers in a dilemma between responsibility and profit. At the same time, ESG practices of enterprises are not always smooth and may not always meet the expectations of all stakeholders. When the actual ESG performance of an enterprise fails to reach the expected level of stakeholders, it is likely to face significant legitimacy crises and reputation pressure. The organizational expectancy theory holds that enterprise decision-makers, constrained by their "bounded rationality", often set a satisfactory expectation target based on historical and social performance, and evaluate the enterprise's business performance based on the gap between actual performance and expected performance, and accordingly adjust the enterprise's strategic goals and action plan. When enterprises face negative performance feedback from ESG performance expectations gaps, this "necessity breeds innovation" decision-making logic will drive enterprises to conduct problem search and seek strategic options that can quickly improve ESG performance and business performance. Against this backdrop, studying how management adjusts business decisions to cope with the adverse effects brought by ESG performance expectations gaps is a topic worthy of in-depth exploration. Existing literature mostly focuses on how enterprises improve their external image through "greenwashing" behaviors and changing the tone of social responsibility reports etc. However, from an internal perspective of enterprises, as a more common, direct and covert behavior, aggressive tax behavior has not been fully discussed. Taxation is an important cost for enterprises, and aggressive tax behavior reduces the tax cost of enterprises, which has a positive effect on improving business performance and enhancing company value When enterprises formulate tax avoidance strategies, they need to consider both the benefits of tax avoidance (such as alleviating cash flow and meeting actual business needs) and the costs of tax avoidance (such as the risk of being inspected and punished and damage to reputation). Then, in the context of legitimacy pressure and internal resource constraints brought by ESG performance gaps, what will be the direction of enterprises' tax strategies? Will they resort to aggressive tax behavior to quickly "remedy" the situation of ESG performance gaps, or will they better restrain their aggressive tax behavior out of concern for long-term reputation and the risk of penalties for violations? In light of this, this paper uses listed companies on the Shanghai and Shenzhen A-share markets from 2011 to 2024 as research samples to empirically examine the impact of ESG performance expectations gaps on the aggressiveness of enterprises' tax behavior and its mechanism. The research findings are as follows: (1) When enterprises are in the context of ESG performance gaps, they will significantly increase their aggressive tax behavior; (2) The results of the mechanism test show that ESG performance expectations gaps increase the tax aggressiveness of enterprises by increasing the performance pressure on management, raising the risk-taking level of enterprises, and intensifying the agency conflicts of enterprises. (3) The independence and financial professionalism of the audit committee play a negative moderating role in the relationship between the ESG performance expectation gap and the degree of tax aggressiveness of enterprises; (4) The results of the heterogeneity analysis show that the positive relationship between the ESG performance expectation gap and the degree of tax aggressiveness is more significant in enterprises with a longer duration of the gap, lower tax administration levels, and non-heavy polluting industries. (5) Further tests show that among the dimensions of the ESG performance expectation gap, the performance expectation gap in the social responsibility and governance dimensions will trigger aggressive tax behavior in enterprises, while there is no direct correlation between the performance expectation gap in the environmental dimension and the degree of tax aggressiveness.
