摘要:

数字贸易是全球贸易增长的重要引擎,并逐渐成为国际贸易领域中最具活力与潜力的新兴力量。《数字经济伙伴关系协定》(以下简称“DEPA”)作为全球首个专门以数字经济为规制对象的数字经贸协定,数字产品非歧视待遇是其中对数字贸易自由化追求的体现,并一定程度上具有示范效应,为全球数字经贸规则提供了模板。DEPA具有灵活性强、包容性强的特点,采用模块化的编排方式而非一揽子协定。2021年中国提出加入DEPA申请并持续推进磋商,因此,数字产品非歧视待遇是必须要面临的制度。此外,在我国已提出加入申请的《全面与进步跨太平洋伙伴关系协定》(以下简称“CPTPP”)中也有数字产品非歧视待遇条款,以及我国已经签署的中国—东盟自贸区3.0版升级议定书和已经生效的《区域全面经济伙伴关系协定》(以下简称“RCEP”)中规定要对数字产品的待遇进行对话。在制度型开放的背景下,系统研究DEPA数字产品非歧视待遇具有重要的现实意义。在认定相关措施是否违反数字产品非歧视待遇义务时,核心判定要素是“同类性”和“不低于”待遇,因此本文聚焦于DEPA数字产品非歧视待遇适用中决定是否构成违反此规定的两项核心——“同类性”与“不低于”待遇的认定标准展开研究。本文共分四部分。第一章是DEPA数字产品非歧视待遇规则的概述。这一部分围绕DEPA中数字产品非歧视待遇规则的条文展开总体论述,首先厘清数字产品的定义,再系统考察该规则自美国—新加坡自由贸易协定(以下简称“美新FTA”)以来的发展演变,并从贸易自由化、数字产业发展与文化安全三种价值之间的张力出发,解释DEPA数字产品非歧视待遇规制的框架从何而来。该部分主要结合DEPA的规定,阐明数字产品的界定方式、法律定性的争议及其对适用标准的影响、非歧视待遇条款的规定以及适用。同时指出非歧视待遇适用中“同类性”和“不低于”待遇的判定是核心,然而DEPA对判断数字产品“同类性”和“不低于”待遇的标准不清,这是后文研究DEPA数字产品非歧视待遇认定标准的基础。第二章是DEPA数字产品非歧视待遇中“同类性”的认定标准问题。本章聚焦DEPA“同类”数字产品的判定标准,指出DEPA虽通过“属地 属人”双重标准界定给惠数字产品范围,但并未直接提供根据哪些因素考虑是否构成“同类数字产品”的实质判断标准;同时,数字产品法律定性争议使“同类性”认定在比较对象和比较标准上更趋复杂。为降低不确定性,本文论证在条约解释与制度协调的框架下,参考WTO在争端解决实践中围绕判断“同类性”形成的分析方法,在此基础上提出DEPA数字产品“同类性”认定时依据的标准与考虑的因素。第三章是DEPA数字产品非歧视待遇中“不低于”待遇的认定标准问题。这部分是关于DEPA对数字产品给予“不低于”待遇,那什么待遇可能被认定为较低待遇,即讨论在认定“不低于”待遇时的标准问题。本文认为,DEPA将非歧视义务统一表述为“不低于”待遇,这意味着既禁止法律上的歧视,同样也禁止事实上的歧视,但其未细化“较低待遇”的判断思路。为此,本文以WTO争端解决实践为参照,总结较低待遇认定应以竞争条件是否被改变为关键,并进一步将该判断标准延伸至数字产品领域,探索DEPA不低于待遇的认定标准。本部分还分析了一些边境后措施可能构成歧视待遇,例如数字服务税。第四章是DEPA数字产品非歧视待遇规则对我国的挑战与因应。该部分立足我国加入DEPA的现实背景,评估数字产品非歧视待遇规则对我国的主要挑战与应对。本文针对提出的三项挑战对应地提出了三方面的启示:一是明确我国关于数字产品定性的立场;二是对可能受到质疑的数字产品监管措施的相关规定进行完善,在维护文化安全与意识形态安全底线的前提下,构建更加规范的数字产品监管体系;三是以“混合清单 例外条款”的规制模式正当化数字产品监管措施,并提升程序透明度与效率,在自由贸易试验区先行先试数字产品市场开放,评估可能的风险,缓冲非歧视待遇规则可能带来的对数字产品市场的冲击。

  • 数字贸易是全球贸易增长的重要引擎,并逐渐成为国际贸易领域中最具活力与潜力的新兴力量。《数字经济伙伴关系协定》(以下简称“DEPA”)作为全球首个专门以数字经济为规制对象的数字经贸协定,数字产品非歧视待遇是其中对数字贸易自由化追求的体现,并一定程度上具有示范效应,为全球数字经贸规则提供了模板。DEPA具有灵活性强、包容性强的特点,采用模块化的编排方式而非一揽子协定。2021年中国提出加入DEPA申请并持续推进磋商,因此,数字产品非歧视待遇是必须要面临的制度。此外,在我国已提出加入申请的《全面与进步跨太平洋伙伴关系协定》(以下简称“CPTPP”)中也有数字产品非歧视待遇条款,以及我国已经签署的中国—东盟自贸区3.0版升级议定书和已经生效的《区域全面经济伙伴关系协定》(以下简称“RCEP”)中规定要对数字产品的待遇进行对话。在制度型开放的背景下,系统研究DEPA数字产品非歧视待遇具有重要的现实意义。在认定相关措施是否违反数字产品非歧视待遇义务时,核心判定要素是“同类性”和“不低于”待遇,因此本文聚焦于DEPA数字产品非歧视待遇适用中决定是否构成违反此规定的两项核心——“同类性”与“不低于”待遇的认定标准展开研究。本文共分四部分。第一章是DEPA数字产品非歧视待遇规则的概述。这一部分围绕DEPA中数字产品非歧视待遇规则的条文展开总体论述,首先厘清数字产品的定义,再系统考察该规则自美国—新加坡自由贸易协定(以下简称“美新FTA”)以来的发展演变,并从贸易自由化、数字产业发展与文化安全三种价值之间的张力出发,解释DEPA数字产品非歧视待遇规制的框架从何而来。该部分主要结合DEPA的规定,阐明数字产品的界定方式、法律定性的争议及其对适用标准的影响、非歧视待遇条款的规定以及适用。同时指出非歧视待遇适用中“同类性”和“不低于”待遇的判定是核心,然而DEPA对判断数字产品“同类性”和“不低于”待遇的标准不清,这是后文研究DEPA数字产品非歧视待遇认定标准的基础。第二章是DEPA数字产品非歧视待遇中“同类性”的认定标准问题。本章聚焦DEPA“同类”数字产品的判定标准,指出DEPA虽通过“属地 属人”双重标准界定给惠数字产品范围,但并未直接提供根据哪些因素考虑是否构成“同类数字产品”的实质判断标准;同时,数字产品法律定性争议使“同类性”认定在比较对象和比较标准上更趋复杂。为降低不确定性,本文论证在条约解释与制度协调的框架下,参考WTO在争端解决实践中围绕判断“同类性”形成的分析方法,在此基础上提出DEPA数字产品“同类性”认定时依据的标准与考虑的因素。第三章是DEPA数字产品非歧视待遇中“不低于”待遇的认定标准问题。这部分是关于DEPA对数字产品给予“不低于”待遇,那什么待遇可能被认定为较低待遇,即讨论在认定“不低于”待遇时的标准问题。本文认为,DEPA将非歧视义务统一表述为“不低于”待遇,这意味着既禁止法律上的歧视,同样也禁止事实上的歧视,但其未细化“较低待遇”的判断思路。为此,本文以WTO争端解决实践为参照,总结较低待遇认定应以竞争条件是否被改变为关键,并进一步将该判断标准延伸至数字产品领域,探索DEPA不低于待遇的认定标准。本部分还分析了一些边境后措施可能构成歧视待遇,例如数字服务税。第四章是DEPA数字产品非歧视待遇规则对我国的挑战与因应。该部分立足我国加入DEPA的现实背景,评估数字产品非歧视待遇规则对我国的主要挑战与应对。本文针对提出的三项挑战对应地提出了三方面的启示:一是明确我国关于数字产品定性的立场;二是对可能受到质疑的数字产品监管措施的相关规定进行完善,在维护文化安全与意识形态安全底线的前提下,构建更加规范的数字产品监管体系;三是以“混合清单 例外条款”的规制模式正当化数字产品监管措施,并提升程序透明度与效率,在自由贸易试验区先行先试数字产品市场开放,评估可能的风险,缓冲非歧视待遇规则可能带来的对数字产品市场的冲击。

  • Digital trade has become an important engine of global trade growth and an increasingly dynamic area of international commerce. The Digital Economy Partnership Agreement (“DEPA”), the first digital trade agreement dedicated to regulating the digital economy, reflects a strong commitment to trade liberalization through its non-discriminatory treatment of digital products. DEPA also has a demonstrative effect and provides a template for emerging global digital trade rules. It is designed to be flexible and inclusive, and it adopts a modular structure rather than a single comprehensive treaty. China submitted its application to accede to DEPA in 2021 and has continued consultations. As a result, China will need to confront DEPA’s rules on non-discriminatory treatment of digital products. Similar provisions also appear in the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (“CPTPP”), which China has applied to join. In addition, the upgraded China–ASEAN Free Trade Area 3.0 protocol and the Regional Comprehensive Economic Partnership (“RCEP”) include commitments to dialogue on the treatment of digital products. Against the background of institutional opening-up and strengthening digital governance capacity, a systematic study of DEPA’s non-discrimination treatment of digital products has clear practical value. When assessing whether a measure breaches these obligations, two elements are central: “likeness” and “no less favourable treatment”. This thesis therefore focuses on the standards for determining these two elements under DEPA.This thesis consists of four chapters. Chapter One is an overview of DEPA’s non-discrimination treatment of digital products. It first clarifies the definition of “digital products”, then traces the legislative evolution of these rules since the United States–Singapore Free Trade Agreement (“US–Singapore FTA”). It also explains the underlying policy tensions among trade liberalization, digital industrial development, and cultural and ideological security. Based on DEPA’s text, Chapter 1 discusses the way to define “digital products”, the ongoing controversy over their legal classification and its impact on legal analysis, and the structure and operation of the non-discrimination clause. It further shows that “likeness” and “no less favourable treatment” are the core elements in applying this rule, yet DEPA does not specify clear standards for either element. This sets the foundation for the analysis in the following chapters.Chapter Two is the issue of the standard for determining whether digital products are “like” under DEPA. Although DEPA uses combined territorial and personal criteria to identify covered digital products, it does not provide substantive factors for assessing “likeness”. The unsettled legal classification of digital products further complicates both the choice of product being compared and the applicable analytical approach. To reduce uncertainty, this part argues that, under the logic of treaty interpretation and systemic coherence, DEPA’s “likeness” analysis for digital products can draw on the analytical approach developed in WTO dispute settlement for identifying “likeness”, and on that basis proposes the standards and factors to be considered when determining “likeness” under DEPA.Chapter Three addresses the standard for determining “no less favourable treatment” under DEPA. DEPA uses a unified “no less favourable treatment” formula, which implies a prohibition of both de jure and de facto discrimination. However, it does not elaborate on how to identify “less favourable treatment”. Drawing on WTO practice, Chapter 3 treats changes in competitive conditions as the key criterion and extends this approach to digital products. It also examines certain behind-the-border measures that may amount to discriminatory treatment, such as digital services taxes.Chapter Four examines the challenges posed by DEPA rules on the non-discriminatory treatment of digital products to China and the corresponding responses. This part situates the discussion in the context of China’s prospective accession to DEPA. It evaluates challenges that this rule may present for China and explores possible responses. The thesis suggests: (1) clarifying China’s position on the legal characterization of digital products; (2) improving domestic rules governing digital product regulation to better withstand non-discrimination challenges while safeguarding cultural and ideological security; and (3) using a “hybrid list plus exceptions” approach to justify regulatory measures and provide market adjustment space. It further recommends improving procedural transparency and efficiency, and conducting pilot openings in free trade zones to assess and mitigate potential market impacts.
